Disputes amongst Jewish people must be settled in a Beis Din, a Rabbinical Court. It is forbidden to take disputes outside a Rabbinical Court and have them settled in Arkaois, a secular, non-Jewish severel Issurim, prohibitions, in the Torah. Of course, there are cases when one is allowed to go to Arkaois, and ordinarily one would require Reshus Beis Din, permission from a Beis Din, that this is one of those cases when one is allowed to go to a secular court. There are cases in which even Reshus Beis Din is not required. This issue is quite complex, and even in those cases, one should get advice from a seasoned, experienced Rov in order to find out whether this is indeed one of those cases which is allowed to be taken into Arkaois without Reshus Beis Din. Going to a secular court in order to enforce a Psak that a Beis Din already gave may be one of the cases where prior permission from Beis Din is not required.
