Pensions for Senior Employees

 

There is a concept in halachah called chezkas serarah,vwhich means that a person who attains a position of leadership retains it for life, unless of course, they are negligent in performing their duties. If they’ve become older and unwell and consequently cannot perform all the functions of their job at the same level as previously, but can still partially fulfill their duties, many poskim say that their employer should nevertheless pay them their full salary. Even when one is no longer capable of doing their job altogether, they should be paid a portion of their salary in order to support themselves; after all, when they were hired it was with the intention of keeping them in their employ for their entire life, as halachically required. It is therefore recommended that institutions arrange pension funds for their employees in order to afford them the dignity of supporting themselves in a respectable manner during their senior years.
